DISTANCE SALES AGREEMENT
1. Parties
This Distance Sales Agreement ("Agreement") is entered into electronically between ARES SEYAHAT TURİZM VE TİCARET LTD. ŞTİ. ("Seller") and the customer ("Buyer") who purchases services through www.adarestravel.com.
2. Subject
This Agreement governs the rights and obligations of the parties regarding the online purchase of daily tours and transfer services offered through the Seller's website.
3. Services
The services may include:
- Daily sightseeing tours
- Cultural tours
- Nature tours
- City tours
- Transfer services
- Other daily travel services published on the website
The exact scope of each service is specified on the relevant booking page.
4. Booking
A reservation becomes valid only after the payment has been successfully completed and the booking confirmation has been sent to the Buyer.
The Seller reserves the right to verify reservation details where necessary.
5. Prices
The applicable price is the amount displayed on the website at the time of booking.
Included and excluded services are described on each tour page.
6. Payment
Payments may be made using the payment methods offered on the website, including credit cards, debit cards and licensed online payment systems.
Payments are processed securely through licensed payment service providers.
7. Cancellation, Changes and Refunds
As a general rule, payments are non-refundable once the reservation has been confirmed.
The Buyer is responsible for reviewing all tour details before completing the reservation.
Reservation changes may be accepted only with the Seller's approval and subject to availability.
Where operational reasons, severe weather, safety concerns or force majeure prevent the service from being provided as planned, the Seller may offer an alternative date or another appropriate solution.
Nothing in this Agreement limits any mandatory refund or consumer rights provided under the applicable laws of the Republic of Türkiye.
8. Seller's Responsibilities
The Seller undertakes to provide the purchased service in accordance with the published program, protect reservation records and process personal data in compliance with applicable legislation.
Reasonable changes to the itinerary may be made where required for operational or safety reasons.
9. Buyer's Responsibilities
The Buyer agrees to:
- Provide accurate information;
- Arrive at the meeting point on time;
- Carry any required identification or travel documents;
- Follow the instructions of guides and staff; and
- Comply with the tour rules.
The Buyer is responsible for any consequences arising from inaccurate information.
10. Force Majeure
Natural disasters, pandemics, governmental decisions, wars, terrorist incidents, transportation disruptions, extreme weather and similar events beyond the reasonable control of the parties shall be treated as force majeure.
11. Personal Data
Personal data is processed in accordance with the Company's Privacy Notice and applicable Turkish data protection legislation.
12. Evidence
Electronic booking records, payment records, emails and system logs may be used as evidence in case of disputes, to the extent permitted by law.
13. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the Republic of Türkiye.
Any disputes shall be resolved before the competent Consumer Arbitration Committees or Consumer Courts in accordance with the applicable consumer legislation.
14. Effectiveness
By completing the online reservation, the Buyer confirms that they have read, understood and accepted this Agreement electronically. The Agreement becomes effective upon electronic acceptance.
